In response to the article
on the charter situation in Tuscany
, we publish a letter we received from a reader, Angelo Canciello, who practices occasional charter activities with his boat, that is, he takes paying guests out to sea:
“In today’s life I am a practicing lawyer at the Court of Rome but I have always had several boats since 2005 in the Sorrento Peninsula. In 2015 I considered buying a sailboat “Bavaria 36” named “Calipso,” meeting my space needs.
Accomplice to the young age and the lack of a company with which to navigate, after analyzing the Legislative Decree 171 / 2005 Article 49bis. (occasional rental), I thought it was only fair to be able to bring paying guests around.
In keeping with my ethics, I immediately took steps to regularize a possible offer on the market by preparing an appropriate declaration “of occasional hire ” to be transmitted, before setting sail, to the competent bodies (harbor master’s office and revenue agency).
In compliance with the bilateral covenants and contract rules, I thought it right to also transcribe a bilateral contract with the paying guest in order to detail the terms and price. I clearly regularized my insurance position to prevent unpleasant consequences. Payment is always by bank transfer or cash in cases of small amounts, although in 90 percent of cases no guest arrives on board with more than 100 euros in cash.
For this reason, I would like to respond to the accusations, and to the appellation of “squatters ” that often besmirch the honest world of occasional chartering, by making it known to the Tuscan charterers that we boaters who practice occasional chartering:
1) We offer a service other than renting.
2) we are legitimized by Article 49a of Legislative Decree171/2005.
3) We pay what we owe to the state through the F24 form, and it makes no sense to take risks to produce abusive revenue.
4) we are systematically subjected to the sea and port controls that, here on the Coast, occur repeatedly.”
