Evinrude’s E-Tec 40, the 40-horsepower outboard, can be driven without a license in Italy. After the House (Feb. 12) and now the Senate passed the “Milleproroghe” decree, now with the publication in the official gazette it is done!

Since the day after publication, the E-Tec 40 can also be used in Italy without a license.

The Milleproroghe amends the recreational boating code, which also allows the Evinrude E-Tec 40 to be used without a license. Specifically, in Article 13, after paragraph 5, a new paragraph 5-quater provides that “to Article 39(1)(b) of the above-mentioned Code. [codice della nautica da diporto] referred to in Legislative Decree No. 171 of 2005, the words, “a750 cc if two-stroke carbureted or fuel-injected” shall be replaced by the following, “a750 cc if two-stroke carbureted or 900 cc if two-stroke fuel-injected.””

In essence, the Milleproroghe also intervened in the amendment of the Boating Code to ensure the unlicensed operation of FB engines of less than 40 hp., but displacement greater than 750 CC. A Confindustria Nautica and in particular Roberto Neglia, as the person in charge of institutional relations, is to be credited in the successful resolution of this issue. After two years of extensions, promises and resounding forgetfulness on the part of the state, the situation seems to have come to a positive outcome in favor of small boat users and boat rental and leasing companies.

The boating license requirement in Italy: for whom does it remain?

On the other hand, the requirement for a boat license remains for the other cases covered by paragraph (b) of Article 39 of the Code:

  • Engines larger than 750 cc if carbureted;
  • 1,000 cc engines if carbureted or fuel-injected four-stroke outboard;
  • engines to 1,300 cc if carbureted or fuel-injected four-stroke within board,
  • 2,000-cc engines if non-supercharged diesel cycle, or 1,300-cc engines if supercharged diesel cycle, however, with a power output of more than 30 kW or 40.8 hp.
